2. What these terms cover
These terms cover your use of the website and the information on it. They do not govern any project, retainer or consulting engagement. Those are governed by a separate written agreement, a proposal, statement of work, master services agreement or NDA, signed by both parties. Where those documents and these terms conflict, the signed agreement prevails for that engagement.
3. Eligibility
You must be at least 18 years old and capable of entering a binding contract under the Indian Contract Act, 1872 to use this site or submit an enquiry. If you are using the site on behalf of a company, you confirm you are authorised to do so.
4. Intellectual property
All content on this site, text, design, layout, graphics, illustrations, animations, code, the Veltrix name and logo, is owned by Veltrix or used under licence, and is protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable law.
You may view, browse and print pages for your own internal, non-commercial evaluation. You may not:
- copy, reproduce, republish or redistribute any part of the site for commercial purposes;
- use our name, logo or branding without our prior written permission;
- remove or obscure any copyright, trademark or other proprietary notice;
- scrape, mine or systematically extract the site's content, including for training machine learning models, without our prior written permission.
Case studies and project descriptions on this site are published with the relevant client's permission. Ownership of work delivered in an engagement is determined by that engagement's signed agreement.
5. Acceptable use
You agree not to:
- use the site for any unlawful purpose or in breach of any applicable law;
- attempt to gain unauthorised access to the site, its servers, or any connected system;
- probe, scan or test the vulnerability of the site without our prior written consent;
- introduce malware, or any code intended to damage or interfere with the site;
- overload the site or its APIs, including through automated or high-volume requests;
- submit false, misleading, abusive, defamatory or infringing content through our forms;
- use the contact form to send unsolicited commercial messages or spam.
We may restrict or block access where we reasonably believe these terms are being breached. The contact form is rate-limited, and repeated abuse may be reported to the relevant authorities.
If you believe you have found a security vulnerability in this site, please tell us privately at [email protected] before disclosing it publicly. We will not pursue action against good-faith research reported this way.
6. What you send us
When you submit an enquiry, you confirm that the information is accurate and that you are entitled to share it. Please do not send confidential information through the contact form. An initial enquiry is not covered by an NDA. If you need confidentiality before talking, tell us and we will put an NDA in place first, we work NDA-first as a matter of course.
If you send us an unsolicited idea, suggestion or feedback about our own services, you agree we may use it without obligation, payment or attribution. This does not apply to information shared under a signed NDA or during a paid engagement, which remains yours and stays confidential.
7. No professional advice
The content on this site is general information about what we do. It is not technical, legal, financial or professional advice, and you should not act on it without advice specific to your circumstances. Timelines, capabilities and outcomes described here are illustrative, every project differs, and nothing on this site is a guarantee of a particular result.
8. Availability and third parties
We aim to keep the site available, but we do not guarantee uninterrupted access. We may modify, suspend or withdraw any part of it without notice.
The site links to third-party services and loads resources from them, including Calendly for scheduling, Google Fonts for typefaces, and a public CDN for JavaScript libraries. We do not control those services and are not responsible for their content, availability or practices. Their own terms and privacy policies apply when you use them.
9. Disclaimer of warranties
The site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted availability. We do not warrant that the site is free of errors or that it or its servers are free of harmful components.
Nothing here excludes liability that cannot lawfully be excluded.
10. Limitation of liability
To the fullest extent permitted by Indian law, Veltrix and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, business, goodwill or data, arising out of your use of, or inability to use, this website, whether in contract, tort, negligence or otherwise.
Our total aggregate liability arising from your use of this website will not exceed ₹10,000. This limit applies to the website only. Liability arising from a project engagement is governed by the liability terms in that engagement's signed agreement.
11. Indemnity
You agree to indemnify and hold Veltrix harmless against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, or your violation of any law or third-party right.
12. Project engagements
Nothing on this website is an offer capable of acceptance, and submitting an enquiry does not create a contract or a client relationship. A project begins only when both parties sign a written agreement setting out scope, deliverables, timeline, fees and payment terms.
We do not take payment through this website, so no refund or cancellation policy applies to it. Payment, cancellation and refund terms for an engagement are set out in that engagement's signed agreement. Fees quoted are exclusive of GST and other applicable taxes unless stated otherwise.
13. Privacy
Our Privacy Policy explains how we handle personal data, and our Cookie Policy explains what we store on your device. Both form part of these terms.
14. Changes
We may update these terms from time to time. The "last updated" date above reflects the current version, and changes take effect when published. Continuing to use the site after that means you accept the revised terms.
If any provision of these terms is held invalid or unenforceable, the rest remain in full force. Our failure to enforce any provision is not a waiver of it.
15. Governing law and disputes
These terms are governed by the laws of India. Subject to the paragraph below, the courts at Karjat, Maharashtra, India, have exclusive jurisdiction over any dispute arising from them.
We would rather resolve things by talking. If a dispute arises, please contact us first and we will try in good faith to settle it within 30 days. If that fails, the dispute will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration will be Karjat, Maharashtra, India, and the proceedings will be conducted in English.
